HPTET : Interim bar by Himachal HC on appointment of teachers


The Himachal Pradesh High Court Monday restrained the state education department from making any appointment to post of teachers without permission of the court. The court further sought information from the deputy directors (education) of all the districts in the state regarding number of appointments made for the post of teachers during the period of August and September, 2012.

While passing this interim order a division bench comprising the Chief Justice Kurian Joseph and Justice Dharam Chand Chaudhary observed that presently it appears that there is no clarity in the appointment process of teachers. The court noted that unless the National Council for Teachers Education (NCTE) permits, there cannot be any exemption from passing the Teachers Eligibility Test (TET) for the purpose of appointment to the impugned post.

It further added that the appointments also cannot be made otherwise than the normal process of recruitment conducted by the Board. The appointment on batch-wise basis can be made only on the basis of merit in the batch concerned and not on the merit in the Teachers Eligibility Test (TET), it was observed.

The court passed this order on a petition filed by one Kamlesh Rana alleging that proper norms are not followed in the recently concluded appointments. The case has been listed for October 31.

Petitioner was represented by her counsel Archana Dutt Sharma.
